A "defective product" is a product that causes some injury or damage to person as a result of a defect in the product or its labeling or the way the product was used. The manufacturer, and others involved in the chain of commerce involving the products that caused the injury, are often liable for injuries defective products cause. So says FreeAdvice.com. Also, there are three basic legal theories that are applicable to all jurisdictions regardless of the state which are an important foundation of a successful product liability case. Manufacturing defect is all about flaws in the manufacturing process. Design defect on the other hand is due to poor design though there may not be a defect in the product itself. Lastly is the failure to warn or inadequate warning which could potentially pose a threat to the consumer.

The responsibility ultimately falls on the manufacturer or seller of the defective goods that have caused injuries on the end user. The liability extends to all the members of the “chain of commerce” which include the distributors and retailers even though they themselves did not cause the defect. In the case of a defective component, the maker of said component may be held liable as well as the manufacturer of the larger product.
