PERSONAL INJURY LAW: Jury Junks $19 Million Brain-Damage Lawsuit against Hospital
April 14, 2010
Los Angeles - A jury has junked a $19 million case filed by a man who alleged that the Children’s Hospital of Los Angeles and the two doctors working in it are responsible for his infant son’s brain damage.
Reports stated that Eduardo Rivas, from Tujunga, alleged that Nathan, his 6-month-old baby, was operated on to fix a double hernia without his consent.
The father further alleged that his son, who is now almost 3-years-old, was left with an infant’s mental capacity because of a bad reaction to the anesthesia.
According to reports, the hospital said Rivas gave his consent by the phone. It pointed that the boy was suffering from brain damage because he was born about four months premature.
Riva’s lawyer said the cost of the boy’s health care already exceeded $900, 000, but is shouldered by Medi-Cal.
