Tort Law and how it is being used in America
In some parts of America, it can be said that people have the tendency to be oversensitive especially in matters pertaining to personal injuries and the like. Some of the common accidents being consulted to injury attorneys are those involving premises liability such as slip-and-fall accidents in malls or houses of other people.
However, this very “American” sensitivity is highly regarded as normal behavior on the very soil which these laws are implemented. Although not every city, town, or state seems to implement such kind of behavior, the effect is evident with the proliferation of law firms in many of the main attractions of the United States.
Some of the cities whose citizens are well oriented with this odd normalcy are the following:
- Los Angeles, California
- New York City, New York
- Las Vegas, Nevada
Although the situation on these can be characterized as overtly reactive over small matters, the law still provides the complexities of tort law for a good reason.
For one, tort law is a form of protection for a multitude of possible abuses or neglect that can arise in any situation. These include the breach of the duty of care of the owner toward his visitors.
Second, tort law dictates the terms of how to calculate the total amount that could be claimed by a complainant. Hence, no “unreasonable” claim can be made since it is in the power of the injury attorney to compute whether the case is significant or not to merit a claim in the first place.
Third, tort law also has the power to give a chance to the defendant to avert the accusations through the mechanisms of Comparative and Contributory Negligence depending on the state where it is being implemented.
And finally, tort law is a form of compensatory measure for great crash accidents where the casualties are too high to be ignored anymore. Traumatic Brain Injuries, wrongful deaths, spinal cord injuries are among the examples of the worst possible results of accidents.
