Personal Injury Law: $6.4 Million Settlement Reached between Roseville and Quadriplegic Man

October 12, 2010

Roseville – A personal injury settlement has been reached between the City of Roseville and a quadriplegic man who sued the city after falling from a bus wheelchair-lift, reports said.

Thomas Avery was awarded $6.4 million by a Placer County jury.

Court records said Avery sustained brain damages after the lift collapsed underneath his wheelchair, which dropped him in his head.

It turned out that the bolts of the lift were either missing or loose.

The fall accident resulted in brain damage, short term memory loss, wherein he does not even remember the accident, and loss of sense of taste and smell.

The city initially offered a smaller settlement package to Avery but he took his chances in court believing that he deserves more.

Avery sued the City of Roseville and the bus contractor, and he ended up winning a record settlement from the city.
